List of rules and conditions for service provision:
The client automatically agrees to these terms after paying for any service or topping up the balance in the personal account.
Ignorance of the rules does not exempt from responsibility!
1.0 General rules for all services
1.1 Spam in any form is prohibited: incoming/outgoing/spam via websites, etc.;
1.2 Placement of programs for unauthorized access or disrupting/blocking system operation is prohibited;
1.3 Publishing any materials that violate copyright of their owners is prohibited (this includes links to such sources or file-sharing sites);
1.4 Posting pornographic materials (including links to such resources) is prohibited unless allowed by the legislation of the hosting country;
1.5 Use of traffic-generating programs is prohibited.
1.6 Posting fakes, exploits, viruses is prohibited;
1.7 Hosting websites and materials prohibited by the legislation of the Republic of Moldova is forbidden.
1.8 Use of mining software on VPS and CPU usage exceeding 75% constantly is prohibited;
1.9 DDoS attacks and VPS actions that may cause disconnection of other systems are forbidden.
1.10 Any actions that may cause listing in Spamhaus, Spamcop, Cert, and others are prohibited.
1.11 Scanning and password guessing of any sites and servers is forbidden.
1.12 Use of IP addresses not belonging to the client is prohibited.
1.13 Running game servers or other high-performance software on VDS servers is prohibited.
1.14 Hyper Hosting SRL has zero tolerance for any cybercrimes. Upon request from law enforcement agencies, all client information will be provided.
2.0 Rights and obligations of the parties!
2.1 The client agrees not to violate the rules described in section 1.
2.2 Violation of these rules by the client results in refusal of service without refund for the unused period. If reputational or financial losses occur to the company, the client must cover them; otherwise, Hyper Hosting SRL will take legal action.
2.3 The client must pay for services timely. The minimum rental period is 1 calendar month, during which the service cannot be deleted.
2.4 The client has the right to a payment deferral of one week. If payment is not received, the service will be deleted without recovery possibility.
2.5 Service transfer by the client is only possible after verification.
2.6 Hyper Hosting SRL reserves the right to refuse or terminate services to any client at its sole discretion without explanation, as well as to request client verification.
2.7 Hyper Hosting SRL is not responsible for damages caused intentionally or unintentionally by the client, or by third parties.
2.8 Any changes to the service rules, tariffs, etc., will be published on the website in the news section and sent to all clients. All changes take effect upon publication.
2.9 The company is not responsible for losses or missed profits caused by force majeure, DDoS attacks, scheduled maintenance for service improvement, or planned data center works, except when compensation is initiated by Hyper Hosting SRL.
2.13 These rules may be changed or supplemented unilaterally.
Below are the main obligations of technical support and Hyper Hosting SRL
3.0 Technical support must:
3.1 Ensure infrastructure operability.
3.2 Promptly resolve all issues affecting client service operability.
3.3 Provide uninterrupted access to client VPS servers and quickly eliminate all obstacles.
3.4 In case of hosting rule violations, block the account with mandatory notification to the account owner.
5.0 Payment and refunds:
5.1 Refunds from the client’s account are only possible up to the displayed balance. No refunds will be issued in case of violation of rule 1.
5.2 Refunds are not possible for services already provided.
5.3 Withdrawals are made exclusively to the system from which the funds were received, minus system commission. Additional verification may be requested if needed.
6.0 Service deletion terms:
6.1 All unpaid VPS services will be deleted 7 days after the payment expiry. The client may request a deferred payment for no more than 7 days. If funds are not received after activation of the deferred payment, the client’s service will be irreversibly deleted.
6.2 If the client violates service usage rules, the company reserves the right to delete the service earlier without refund for the remaining period.
